Changed your name after divorce? Here's what you need to do about your property documents

A divorce and change of name can make property documents a little confusing, especially when the property was purchased in your married name. The good news is that changing your name does not affect your ownership of the flat.

However, it is sensible to keep proper documents linking your old and new names so that you do not face difficulties when dealing with the property in the future. Today's Q&A explains such details in response to a query by a reader.

As the PAN mentions father’s name even for a married female, your PAN before divorce and after change of name will have the same father’s name though with your different surname which with same date of birth this will help you in establishing your identity.

I would advise you to prepare a file with all the relevant documents containing at least the following documents:

• Sale deed for purchase of the flat in 2023

• Marriage Certificate if obtained

• Divorce Decree

• Old and amended PAN card

• Old and amended Aadhaar Card

• Electricity Bill old and new

• Maintenance bill from the housing society

• Affidavit as stated above.

Still if you wish, you can execute a rectification document stating the fact of change of your change consequent to divorce decree in relation to the sale deed of the property and get the same registered.

You should also get your name in the municipal office for your flat. Since the latest municipal tax invoice will also have your maiden name, I do not think there should be any problem in establishing your ownership of the flat in future.
