Can they claim the investments if they have an OCI card? Will they need to travel to India, open an Indian bank account or go through lengthy legal procedures?

Today's Q&A explains such details in response to a query by a reader.

Question: Can you help me with this query related to claim case of death of an Indian citizen whose spouse and daughter both are US citizen with an OCI card. Presently, they do not have any bank account in India. In case of death, how will spouse and daughter who are the registered nominees, get claims from mutual funds in India?
Answer: On death of an Indian citizen investor who has nominated non-Indian citizens as nominee, the mutual fund houses do not liquidate the investments but will transmit the investment in the name of registered nominee/s on production of requisite documents.
Since the spouse and daughter both are registered as nominee of the deceased person the mutual fund house will transmit the investments in mutual funds in the name of the nominees without complex court proceedings (such as obtaining a succession certificate). Please note that the mutual fund house will insist for KYC for the non-resident nominees before the investments are first transferred in their names.

The spouse and daughter can open an NRO account remotely from the US with any of major Indian banks (such as ICICI, HDFC, SBI, or Axis). For opening an NRO account the nominees will need to provide basic documents like US Passport, OCI Card, US Proof of Address, Indian PAN card (if available). They can apply for PAN if do not have one.

Once NRO account and KYC are done, submit transmission request to the respective mutual fund house or their registrars. You need to attach certified copies of death certificate, copy of cancelled cheque and specimen signature duly attested with the transmission request. It may be noted that though the mutual fund house will transmit the investments in the name of the nominees, they are accountable to the legal heirs for investments so transmitted in their names.

If the nominees wish they can redeem the investments once new folio is created with transmitted investments. Since spouse and daughter are non-resident for income tax purposes, the fund house will deduct tax at source on the profit element in the mutual fund redemption amount at rates depending on period of holding and nature of mutual fund schemes.

A non-resident is permitted to remit upto 10 lakh USD every year from India after submitting certificate from a chartered accountant to the remitting bank.
