Form 16 serves as a key reference for filing Income Tax Returns (ITR), summarising an employee's salary income and the tax deducted at source (TDS) during the financial year.

However, mistakes in Form 16, ranging from incorrect PAN details to discrepancies in TDS figures, can create hurdles during tax filing and even lead to notices from the Income Tax Department.

Experts warn that taxpayers should not ignore errors in Form 16. Since the document is prepared by employers based on salary and TDS records, inaccuracies can result in incorrect tax filings, delayed refunds, or even notices from the Income Tax Department.

While errors in Form 16 are not very common, they can occur due to data-entry mistakes, incorrect tax calculations, or mismatches in TDS reporting. Tax experts say employees should carefully scrutinise the document and seek corrections immediately if any discrepancies are detected.

"In case your Form 16 has some mistakes, it becomes important that you address the matter right away since not doing so can lead to notice from the tax authorities or delayed refund. For this purpose, you need to first check if there is any inconsistency in the details such as your PAN number or the total amount of TDS deducted or paid against your salary. It becomes important that you inform your employer regarding these inconsistencies and make him aware about your need for a correct form. Once done by your employer, the changes will get updated in your online tax credit statement," said CA Gaurav Singh Parmar, Associate Director, Fincorpit Consulting

Echoing similar concerns, CA Abhishek Soni, CEO and Co-founder of Tax2win, says taxpayers should not rely solely on Form 16 without verifying the information it contains. He highlights several important checks and corrective measures that can help salaried employees avoid errors while filing their income tax returns.

According to Soni, salaried employees should take the following steps if they identify any discrepancies in their Form 16 before filing their income tax returns.

What should you do if your Form 16 contains errors?

1. Inform your employer immediately

Contact your HR or payroll team and request a corrected Form 16. Common errors include incorrect PAN, wrong salary details, missing exemptions, or incorrect TDS figures.

2. Verify with Form 26AS and AIS

Before filing your return, compare the TDS details in Form 16 with your Form 26AS and Annual Information Statement (AIS). If TDS shown in Form 16 does not appear in Form 26AS, you may face difficulty claiming the credit.

3. Check salary and deduction carefully

Review all components such as salary income, exemptions, deductions, perquisites, and employer contributions. Even small mistakes can affect your tax liability or refund amount.

4. Use correct information while filing ITR

Your income tax return should be based on the correct figures, not necessarily the incorrect figures mentioned in Form 16. If you have supporting documents, you can use the accurate details while filing your return.

5. Keep records of communication

If the employer delays or refuses to issue a corrected Form 16, keep emails and other communication records. These may help explain any mismatch if the Income Tax Department seeks clarification later.

With ITR filing season underway, a careful review of Form 16 can help taxpayers avoid filing mistakes and ensure they receive the correct tax credit and refund. Experts recommend cross-checking the document with Form 26AS and AIS and seeking corrections from employers wherever necessary before submitting returns.
