Who can file ITR-2?

The online ITR-2 form on the Income Tax portal is pre-filled with your relevant data. This form is generally used by taxpayers having income from salary, pension, capital gains, and other sources.

This year, you can use ITR-1 for reporting LTCG up to ₹1.25 lakh from equity shares and equity mutual funds. For any other capital gains, you may need to use ITR-2, depending on eligibility.

This form can be used by an individual or a Hindu Undivided Family (HUF) who is not eligible for ITR-1 and does not have "profit and gains of business or profession”.

Further, the ITR-2 filer should not have income from “Profits and gains of business or profession” like interest, salary, bonus, commission, or remuneration, by whatever name called, due to, or received by him from a partnership firm.

The ITR-2 form may also be used where the income of another person, like spouse, minor child, etc., is to be clubbed with the income of the taxpayer. However, it should be used only when the above conditions are met.

Who should not use ITR-2?

ITR-2 should not be used by an individual or HUF whose total income for the year includes income from profit and gains from business or profession, and also having income like interest, salary, bonus, commission, or remuneration, by whatever name called, due to, or received by him from a partnership firm.

Further, the ITR-2 form should not be used when the taxpayer is eligible to file ITR-1.

The ITR-2 form for AY 2025-26 has several changes compared to the previous years. These changes have been introduced to improve tax compliance. You can read about these changes here.

The due date to file ITR has been extended this year for taxpayers who do not need an audit. Now you can file your returns till September 15, 2025. As of July 18, 2025, over 1.41 crore returns have been filed, while the Income Tax Department has processed more than 1.12 crore verified returns.
