IndiGo files trademark infringement case against Mahindra Electric for using '6E' in its EV

InterGlobe Aviation, the operator of India's largest airline IndiGo, filed a trademark infringement case against Mahindra Electric Automobile Ltd, a subsidiary of Mahindra & Mahindra, in the Delhi High Court for using '6E' in its new electric vehicle (EV), Bar and Bench reported.

Mahindra & Mahindra launched two EV models, the Mahindra BE 6e and the Mahindra XEV 9e, last week. Electric brand deliveries are expected to start in February or March next year.

According to Bar and Bench, the case came up for hearing before Justice Amit Bansal, who chose to recuse himself from the matter. The case is likely to come up for hearing on Monday, December 9, the report said.

The '6E' case

IndiGo Airlines operates under the code '6E', which is its International Air Transport Association (IATA) airline designator and a key part of its branding. The company offers various services with 6E brandings, such as 6E Rewards, Super 6E (Extra baggage allowance, fast forward and lost baggage protection), 6E Prime (Seat selection, snacks and fast forward) and 6E Seat and Eat, among others.

In 2015, IndiGo registered the word mark '6E Link' under class 9, class 16, class 35 and class 39 for advertising and transport of passengers and goods.

The registrar of trademark, as per Bar and Bench, approved Mahindra Electric's request to register 'BE 6E' in class 12, allowing the automaker to use 6E in motor vehicles (excluding two-wheelers).

IndiGo has challenged the same and has reached out to the intellectual property division of the Delhi High Court, the report said.

The Mahindra BE 6e starts at 18.90 lakh. The base variant offers a 59 kWh battery pack and a 535-kilometre range. The EV has a rear-wheel-drive setup with six airbags and all-wheel disc brakes.

Recently, Mahindra & Mahindra committed ₹4,500 crore for the development of electric brands BE 6e and XEV 9e, including the creation of production capacity at its Chakan-based plant.
