8th Pay Commission: HC judgement triggers fresh demand for commutation of pension changes; BPS writes to 8th CPC

The Bharat Pensioners Samaj (BPS), a federation representing nearly one million pensioners through 245 affiliated associations, has written to the 8th Central Pay Commission and the Department of Pension and Pensioners' Welfare (DoPPW)seeking restoration of commuted pension after 11 years, backed by a fresh actuarial review of the commutation rules.

Currently, as per Rule 10-A of the CCS (Commutation of Pension) Rules, 1981, the commuted amount of the pension is restored on completion of 15 years from the date the reduction of pension or completion of recovery for 15 years on account of commutation becomes operative.

In case the commutation is paid on multiple occasions following pay revisions, each tranche carries its own 15-year wait.

The BPS' letter is seeking changes to the restoration of commutation of pension rules in the wake of a recent judgment of the Himachal Pradesh High Court, dated September 16, 2026.

In this case (CWP No. 15995 of 2024, Bal Dev & Others v. State of Himachal Pradesh & Others), the High Court examined the issue in the context of substantial changes in the actuarial and economic parameters underlying pension commutation.

As per BPS' letter, the HC also examined the following:

• Change in commutation factors: The factor at age 58 has reduced substantially-from the historical figure of 10.46 to 8.194 for Central Government employees.

• Changes in interest/discount rates and economic conditions, which materially affect the actuarial basis of the commutation calculation.

“The Hon'ble Court did not itself order reduction of the 15-year period but emphasised the need for the Government to examine the issue rationally in the light of changed circumstances and relevant actuarial parameters, balancing the interests of the Government and retirees,” BPS said.

The pensioners' federation has sought a fresh actuarial review of the commutation table, factors, interest rates and mortality data, and, “as an immediate measure, restoration of the commuted portion after 11 years may kindly be examined.”

The BPS also asked for an expert committee of actuaries, ministry and 8th CPC representatives and pensioners' organisations to make “time-bound recommendations,” followed by amendments to the CCS (Commutation of Pension) Rules, with any revised provision extended to existing pensioners “wherever legally and administratively feasible.”

The BPS letter, copied to the Secretary (Expenditure) and the Members of the Commission, is not a first word on the subject. Earlier, a delegation led by BPS President R.K. Chauhan and Rajput had presented the federation's demands to the Commission on 7 August, which included a demand for the “restoration of the commuted portion of pension after 11 years or on attaining the age of 71 years, whichever is earlier, for employees retiring at the age of 60.”
